Terms of service

These terms are an agreement between you and Prism Wings, based in the United Kingdom ("we", "us"), covering the Prism Wings mobile game and the website at prismwings.com (together, "the service"). By installing or playing Prism Wings, or using this site, you agree to them. If you don't agree, don't use the service.

The short version

• Your account and your progress are yours to enjoy; the game and everything in it remain our property, licensed to you to play.
• Cards, gems and other in-game items are part of the game. They have no money value and can't be sold for money.
• Play fair. Cheating, exploits, abuse and scamming can cost you the account.
• Trades between players are final once both sides confirm.
• If something goes wrong, email us first and we will try to sort it out like people.

1 · Your account

The game creates an anonymous account for you automatically so your progress can be backed up, and you may optionally link it to an Apple or Google sign-in for recovery. You must be at least 13 years old to create an account, and if you are under the age at which you can agree to these terms yourself where you live, a parent or guardian must agree for you.

You are responsible for the activity on your account and for keeping access to any linked sign-in. One account is for one person: accounts may not be shared, sold, gifted, rented or transferred, and buying or selling accounts is prohibited. You can stop syncing or delete the account at any time, as described in the privacy policy.

2 · Your licence to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play Prism Wings on devices you own or control, for your own entertainment and not for any commercial purpose. The game and the service, including its cards, artwork, characters, names, stories, music, software and design, are our intellectual property or used with permission. All rights not expressly granted are reserved.

You may not, except where the law expressly permits it:

• copy, sell, rent, lease, redistribute or sublicense the game or its assets;
• reverse engineer, decompile, datamine or extract the game's code, data or assets;
• use the game's artwork, names or other content commercially without our written permission.

Fan content made for free community enjoyment is welcome; if you are unsure whether something crosses the line, ask us.

3 · Virtual items

Cards, gems, shards, packs, orbs and every other in-game item are virtual items: a part of the game, licensed to you under these terms for as long as your account and the service exist. Virtual items are not property, have no monetary value, cannot be exchanged for money or anything of value outside the game, and are not refundable except where the law requires it.

We may adjust, rebalance, add or retire virtual items as part of operating and balancing the game, with or without notice, and you have no entitlement to compensation for changes made in good faith to keep the game fair and fun. In-game trading moves a virtual item between accounts inside the game only. Selling, buying or advertising virtual items or trades for real money or outside value is prohibited.

If the game offers purchases in future, payment is handled by the app store you bought through (Apple's App Store or Google Play), under that store's payment and refund terms as well as these terms. Purchased currency is a virtual item like any other once delivered.

4 · Playing fair

Don't do these. They can cost you the account:

• Cheating: exploiting bugs, tampering with the client, the save data or network traffic, or using bots, automation, mods or any software that changes how the game behaves.
• Manipulating matches, rankings or the wanderer system, including win-trading and faked encounters.
• Abusing, harassing or threatening other players, or choosing an offensive display name.
• Scamming or attempting to scam trades.
• Interfering with the service, probing or attacking our servers, or attempting to access other players' accounts or data.
• Using the service for anything unlawful.

Where a violation is minor and honest, we will normally warn before we act. Where it threatens other players or the game's economy, we may act first. If you find a bug that gives an unfair advantage, report it to us rather than using it; we remember the difference.

5 · Player-to-player features

Battles, trades and nearby-player encounters connect you with other people. Trades are final once both sides confirm: we are not a party to your trades and cannot restore a card you traded away by choice. Be sensible about who you interact with. You can report a player from their profile, and we moderate reports. We may remove display names or profile content that breaks these terms.

6 · Your content and feedback

The service displays some things you create, such as your display name and the profile you choose to showcase. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for the purpose of operating and promoting the service. You keep whatever rights you have in it, and the licence ends for content that is deleted, except as needed for backups, moderation records and legal compliance.

If you send us ideas, suggestions or feedback, we may use them without restriction or payment. Please don't send ideas you would want paying for.

7 · Updates, changes and availability

Prism Wings is a live game. We may update it, and an update may be required to keep playing online features. We may change, suspend or retire features, events, cards and virtual items as part of operating the game. Solo content is playable offline; online features need a network connection and our servers, and we do not promise uninterrupted operation.

If we ever discontinue the service entirely, we will give reasonable notice in the app or on this site. Virtual items exist only within the game and end with it.

8 · Suspension and termination

We may suspend or permanently close an account that breaks these terms, as described in section 4. A closed account loses access to the service and everything on it, including virtual items, with no compensation. If you believe we got it wrong, email us and a human will look at it.

You can stop using the service at any time and can delete your account as described in the privacy policy. Sections that by their nature should survive (intellectual property, virtual items, disclaimers, liability, disputes and this sentence) survive the end of the agreement.

9 · Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent the law allows. We do not promise the service will be error-free, secure or always available.

Nothing in these terms affects the statutory rights you have as a consumer that cannot be limited or excluded by agreement.

10 · Liability

Nothing in these terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. Otherwise:

• we are not liable for indirect or consequential losses, loss of data, loss of progress caused by your device, or losses from events outside our reasonable control; and
• our total liability to you in connection with the service is limited to the amount you have paid us for it in the 12 months before the claim, and where you have paid nothing, to £50.

11 · Your responsibility to us

If your breach of these terms, or your unlawful use of the service, leads to a claim against us by someone else, you agree to compensate us for the losses and reasonable costs that result, to the extent the claim was caused by your conduct. This does not apply to the extent a claim results from our own fault.

12 · Apple and Google

When you install Prism Wings from Apple's App Store or Google Play, the store's own terms apply alongside these, and you agree to comply with them. In addition, for installs from the App Store:

• These terms are an agreement between you and us, not with Apple, and we, not Apple, are solely responsible for the app and its content.
• Your licence to the app is limited to use on Apple-branded devices that you own or control, as permitted by the App Store's usage rules, except that the app may be shared through Family Sharing where enabled.
• Apple has no obligation to provide any maintenance or support for the app. We are responsible for support, at the contact below.
• If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing claims relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
• If a third party claims the app infringes their intellectual property, we, not Apple, are responsible for investigating, defending and resolving that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you as such.

13 · Talking to us, governing law and disputes

If you have a problem with the service, email hello@prismwings.com first and give us 30 days to try to resolve it informally. Most things are fixable this way.

These terms are governed by the law of England and Wales, and disputes belong to the courts of England and Wales, except that if you live elsewhere, you keep any rights and local-court protections your own law gives you as a consumer that cannot be agreed away.

14 · General

• Entire agreement. These terms and the privacy policy are the whole agreement between us about the service and replace any earlier understandings.
• Severability. If part of these terms is found invalid, that part is limited or removed to the minimum extent necessary and the rest continues in force.
• No waiver. Not enforcing a term is not a waiver of it.
• Assignment. You may not transfer this agreement. We may transfer it to a successor who takes on the service, and will tell you if we do.

15 · Changes to these terms

If we change these terms in a way that matters, we will update this page and its date, and flag significant changes in the app or on this site before they take effect where we reasonably can. Continuing to play after a change takes effect means you accept it. If you don't accept a change, stop using the service and, if you wish, delete your account.
